UK-host provides identity details
Last week BREIN received customer details from the UK based hosting provider 3NT Solutions, that uses the servers of the Dutch hosting provider Serverius. These details consists of name, address, e-mail address and payment details. 3NT also ceased its hosting services to the illegal sites at issue. This concerned three linking sites that distributed large amounts of populair movies and television series through illegal files on the servers of an – also illegal – cyberlocker. BREIN now continues its quest against the operators of these sites, as well as the illegal cyberlocker.
It is important that also in these cases of colocation where the
actual hosting provider resides outside of the Netherlands but the
relevant computerservers are located within the Netherlands, BREIN is
able to obtain identifying details of illegal site operators. On the
basis of standard case law in the Netherlands hosting providers should
hand over these details if the criteria set out by the Dutch Supreme
Court in the landmark case Lycos/Pessers are met. More and more
companies outside of the Netherlands, including recently Google, are now
also following these rules.
