Hoge Raad: arrest gerechtshof over blokkade Pirate Bay onjuist

Vandaag oordeelde de Hoge
Raad over de blokkeringsactie die auteursrechtbeschermer BREIN heeft
aangespannen tegen internetprovider Ziggo c.s.. BREIN wil dat access
providers de toegang tot de illegale website The Pirate Bay (TPB)
blokkeren voor hun abonnees. Nadat blokkering eerst was toegewezen, werd
die in hoger beroep afgewezen. BREIN ging daartegen in cassatie bij de
Hoge Raad.

All options open for new blocking actions in The Netherlands
 
Today the Dutch Supreme Court decided on the blocking action that BREIN initiated against Ziggo et al. BREIN wants access providers to block the access of their subscribers to the illegal website The Pirate Bay (TPB). The District Court allowed this, the Court of Appeal did not. BREIN instituted cassation proceedings against this decision in Appeal with the Supreme Court.

De Hoge Raad
heeft het arrest in de procedure tussen BREIN en access providers ZIGGO
en XS4ALL over de blokkering van The Pirate Bay aangehouden. Het arrest

Today the Dutch Supreme Court (Hoge Raad) postponed its decision in
the case between BREIN and the Dutch access providers ZIGGO and XS4ALL
until 20 November 2015.

Dutch Court refers questions to the Court of Justice of the European Union (CJEU) regarding pre-programmed media-players

BREIN acts against a trader in pre-programmed media-players
(Filmspeler). The trader installed add-ons on the media-player with
hyperlinks to illegal websites which offer unauthorized movies,
tv-series, sport broadcasts and music. The media-players are recommended
with slogans like “never to the cinema again”, “Netflix is the past”,
“Never pay again”, “Downloading (from illegal source) is illegal but
streaming is not”. BREIN requests a declaratory ruling that the trader
is infringing copyrights by hyperlinking to illegal content and that
streaming of illegal content constitutes a copyright infringement.

Rechtbank stelt vragen van uitleg aan Europees hof over voorgeprogrammeerde mediaspeler

BREIN treedt op tegen een handelaar in voorgeprogrammeerde mediaspelers. De handelaar heeft add-ons op de mediaspeler geïnstalleerd met hyperlinks naar illegale websites waarop films, series, sportwedstrijden en muziek ongeautoriseerd toegankelijk zijn. De handelaar prijst zijn waren aan met kreten als ‘nooit meer naar de bioscoop’, ‘Netflix is verleden tijd’, ‘nooit meer betalen’, ‘downloaden (uit illegale bron) is illegaal maar streamen niet’. BREIN vraagt een verklaring voor recht dat de handelaar met zijn mediaspeler inbreuk maakt en dat streamen van illegaal aanbod een auteursrechtinbreuk oplevert.
